Terms of Service

1. Acceptance of Terms
By accessing or using Cofy, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the service immediately.
2. Changes to Terms
Cofy, MB reserves the right to update or modify these Terms at any time. We will notify users of material changes by updating the effective date and posting the revised Terms. Continued use of Cofy after changes constitutes acceptance of the new Terms.
3. Service Description
Cofy is a business-to-business (B2B) sales engagement platform that helps professionals manage personalized email outreach campaigns. The Service includes campaign management, a unified inbox for managing replies, campaign analytics, and built-in compliance tools (including unsubscribe mechanisms, sender identification, and physical address insertion).
Cofy is designed exclusively for legitimate B2B sales outreach. Users connect their own email accounts to send one-to-one personalized emails to business contacts. Cofy is not a bulk email marketing tool, an email blaster, or a mass mailing service.
4. User Accounts
Users must create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and agree to notify us immediately of unauthorized use. You are responsible for all activities that occur under your account.
5. Acceptable Use Policy
You agree to use Cofy only for lawful B2B outreach purposes and in compliance with all applicable laws and regulations, including but not limited to:
- The CAN-SPAM Act (United States)
- The General Data Protection Regulation (GDPR) (European Union/EEA)
- Canada's Anti-Spam Legislation (CASL)
- Any other applicable local, national, or international anti-spam and data protection laws
You agree that you will:
- Only contact business professionals who have a legitimate business reason to receive your communication, or from whom you have obtained proper consent.
- Include a valid one-click unsubscribe link in every outreach email (Cofy includes this automatically).
- Include accurate sender identification and a valid physical mailing address in every outreach email.
- Honor all unsubscribe and opt-out requests immediately.
- Use accurate, non-deceptive subject lines and sender information.
- Bring your own contact lists, which you have gathered through legitimate business relationships and/or proper opt-in processes.
6. Prohibited Activities
You agree not to use Cofy for any of the following:
- Spam or unsolicited bulk email. Sending unsolicited commercial email in bulk, or any email that violates applicable anti-spam laws.
- Email warming or deliverability manipulation for Google accounts. Using Cofy to perform email warming, inbox warming, or any form of artificial deliverability manipulation for Gmail or Google Workspace accounts. This is strictly prohibited and violates Google's API policies.
- Circumventing email provider restrictions. Using multiple accounts to bypass sending limits, circumvent spam filters, or otherwise subvert abuse or safety restrictions imposed by any email service provider (including but not limited to Google/Gmail).
- Sending without unsubscribe mechanisms. Sending outreach emails that do not include a valid, functioning unsubscribe link.
- Deceptive practices. Using false or misleading sender names, email addresses, or subject lines.
- Illegal activity. Using the Service for any unlawful purpose or to distribute malware, phishing content, or illegal material.
- Unauthorized access. Attempting to gain unauthorized access to Cofy's systems or other users' accounts.
- Reverse engineering. Reverse-engineering, copying, or distributing the service.
- System interference. Interfering with system operations, security, or service availability.
- Violating Google's Terms of Service or API policies. Using Cofy in any manner that violates Google's Terms of Service, Gmail Program Policies, or the Google API Services User Data Policy. This includes but is not limited to using Google account data for purposes not described in Cofy's Google API Limited Use Disclosure, or any activity that would cause Cofy to be in breach of its obligations under Google's policies.
Violation of any prohibited activity may result in immediate account suspension or termination, without refund.
7. Unsubscribe and Opt-Out Compliance
Cofy automatically includes a one-click unsubscribe link in every outreach email sent through the platform. When a recipient unsubscribes:
- They are immediately removed from all future campaigns by that sender.
- Their email address is added to a global suppression list, ensuring they will not be contacted again by the same Cofy account.
- The process is fully automatic — no manual intervention or delay.
Users may not attempt to circumvent, disable, or override Cofy's unsubscribe mechanism. Doing so is a violation of these Terms and will result in immediate account termination.
8. Google API Services Compliance
If you connect a Google account (Gmail or Google Workspace) to Cofy, the following additional terms apply:
- Cofy's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
- Cofy only requests the minimum API scopes necessary to send emails on your behalf, read replies to your outreach campaigns, and manage campaign-related messages.
- Cofy does not use Google user data for advertising, market research, or any purpose unrelated to providing the Cofy service.
- Email warming is not available for Google accounts. You may not use Cofy to warm up, artificially inflate deliverability, or manipulate sending reputation for Gmail or Google Workspace accounts.

9. Lead Data and Contact Lists
Cofy does not provide, sell, or source lead databases or contact lists. Users are solely responsible for the contacts they upload to and use within Cofy. Users represent and warrant that:
- They have obtained all necessary consents and have a legitimate basis to contact each individual on their list.
- Their contact lists are gathered through their own legitimate business relationships, opt-in processes, or publicly available business information.
- They will not use Cofy to contact individuals who have previously opted out or unsubscribed.
10. Data & Privacy
Your use of Cofy is also governed by our Privacy Policy, which describes how we collect, use, and share personal information. By using Cofy, you consent to the data practices described in the Privacy Policy.
11. Limitation of Liability
Cofy, MB is not responsible for direct, indirect, incidental, or consequential damages arising from the use of Cofy. Users are solely responsible for the content of their outreach campaigns and for ensuring compliance with all applicable laws.
12. Termination
We reserve the right to terminate or suspend access to Cofy at our discretion, with or without prior notice, for violations of these Terms. Specifically, we will terminate accounts that are found to be:
- Sending spam or unsolicited bulk email.
- Using email warming or deliverability manipulation for Google accounts.
- Circumventing sending limits or spam filters of any email provider.
- Disabling or circumventing unsubscribe mechanisms.
- Violating any other provision of these Terms.
13. Fair Usage Policy
We are committed to ensuring that Cofy remains stable, secure, and accessible to all our users. Fair usage means that your use of Cofy should not adversely affect the performance, availability, or security of the service for others.
If we determine, in our sole discretion, that your usage is excessive, abusive, or violates these Terms of Service, we reserve the right to suspend, restrict, or terminate your account or access to Cofy.
14. Governing Law
These Terms shall be governed by the laws of Lithuania, without regard to conflict of law principles.
